1. Introduction & Acceptance of Terms
Welcome to AMOOKSAN. By accessing, browsing, or using our platform, you enter into a legally binding agreement governed by these Terms of Service. AMOOKSAN is an enterprise digital audio asset and sheet music marketplace connecting verified creators, producers, and labels with global content creators, filmmakers, game developers, and broadcasters.
2. Seller Terms & Destination Settlement
Creators must submit a seller onboarding application and complete verification before publishing releases. Payouts are executed either via local banking/PromptPay (for Thai creators) or Stripe Connect Destination Charges (for international creators). AMOOKSAN deducts a transparent 10% platform commission from gross sales. Creators warrant that they retain full publishing and master copyright ownership over every uploaded track.
3. Digital Content & Worldwide Commercial Licensing
Purchasing an audio asset grants the buyer a perpetual, worldwide, non-exclusive, non-transferable synchronization license. The license permits synchronization in commercial videos, YouTube monetization, video games, broadcast advertising, podcasts, and streaming media. Reselling, sub-licensing, redistributing raw master audio files, or submitting tracks to Content ID registries without authorization is strictly prohibited. Audio previews are restricted to evaluation purposes only.
4. Refund Policy, Defective Goods & Statutory Withdrawal Waiver
Under Thailand Consumer Protection laws and EU Directive 2011/83/EU (ยง 356 Abs. 5 BGB), buyers expressly consent to the immediate delivery of digital content and acknowledge the waiver of the statutory 7-to-14-day right of withdrawal once streaming or file download commences. Exception for Defective Files: If a purchased file is proven corrupt, unplayable, missing tracks, or fundamentally mismatched with the preview sample, buyers may submit a refund request within 14 days of purchase. Administration reviews all claims within 7 business days, with remedies including file replacement, store credit with a 10% bonus, or a full refund to the original payment method.
5. Intellectual Property & Anti-Piracy Protection
All uploaded audio files undergo automated cryptographic fingerprinting (MD5 checksum) and metadata scrutiny. Uploading unauthorized samples, unlicensed covers, or infringing third-party recordings results in immediate DMCA takedown, forfeiture of accrued payout balances, and permanent account termination. Bypassing secure MinIO/S3 presigned URL barriers or ripping preview audio streams constitutes a violation of the Computer Crime Act.
6. Platform Governance & Dispute Resolution (ETDA DPS & EU ODR)
Pursuant to Thailand's Royal Decree on Digital Platform Services B.E. 2565 (ETDA DPS) and Regulation (EU) No 524/2013 on Online Dispute Resolution, AMOOKSAN provides an equitable grievance and dispute settlement mechanism. Disputes regarding transaction legitimacy, licensing ambiguity, or copyright ownership may be submitted to [email protected]. Our compliance team mediates and renders binding platform determinations within 15 business days. European consumers may also access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
7. Ranking & Recommendation Transparency (EU P2B Regulation)
AMOOKSAN adheres to strict algorithm transparency standards in accordance with EU Regulation 2019/1150 (Platform-to-Business). Catalog placement across 'Top Releases', 'Trending 24H', and genre discovery is calculated entirely from verified sales volume, rolling purchase frequency, and audio review ratings. AMOOKSAN does not sell paid ranking boosts or manipulate search relevance for undisclosed financial consideration.
